Note: if this statement reads like it takes a lot of words to say nothing that’s because it was written by a lawyer. That’s what they do.

Summary

Our manufacturer for stuffing and delivering the plushes failed, despite assuring us they were en route multiple times. We have sued him after the damage he has caused us and our loyal fans. In the meantime, our development team is investigating taking over management of production directly so the product is actually delivered and our fans can get actual updates on what is happening when it is legally safe for us to make said updates. All refunds for the pre-orders will be respected and no price increases on any previous orders will occur.

Given the lawsuit we are now engaged in, this statement will be shorter and less detailed than we would like. We have more information that we hope to share when it is legally safe to do so. We deeply apologize for this as this goes against our usual policy of transparency when it comes to public relations, but we do promise to tell you the whole story when we can. Our lawyer says you are free to direct your frustration at a lack of candor towards him, but the lawsuit is our way of vindicating our fans and protecting the lawsuit is a way of protecting our fan’s plushes.

To make the situation brief: Our initial contractor who was to obtain the product from overseas, complete it, deliver the product to you, and provide timely updates on this process failed to deliver on his promises. As of the time of writing, we have begun seeking alternative vendors to provide your plushes while the lawsuit progresses. Going forward, our development team is seeking to have direct oversight over this entire process, from stuffing to delivery.

What has Happened Since the Last Update

Since our last update to you, we have strong reason to believe our contractor is never going to perform. Our contractor misled us multiple times. He told us about the order that it had been en route to the USA multiple times, and most recently, that he was ready to ship the product out to you, the customers.

We believe the delivery the contractor promised us will not arrive unless we intervene, which we are doing. As mentioned before, we are currently exploring a variety of options to acquire, finish it, and to distribute the plushies ourselves. Furthermore, we will be starting a lawsuit against this contractor for damages and to acquire any unfinished product.

How We Will Fix It

We plan to undertake shipment, finishing, and delivery of the plushes ourselves. We also have begun legal action against our Contractor and will update you on the details of this when we can. Given the current tariff regime and the legal ambiguity surrounding taking ownership of the unfinished product, we are unsure as to what that timeline will look like. However, as soon as we can, we will provide a subsequent update about the status of the plushes and a proper timeline for delivery.

To those who have preordered a plush and still desire a refund, we will provide you a refund in full. To those fans who wish to still keep their preorder, no price increases on any of your pre-orders will occur.

All this said, we would like to thank all of our customers deeply for their patience during this process, especially regarding the legally-induced silence we had to take in order to protect ourselves and our lawsuit. We want to answer as many questions about the plushes as we legally can now that we’ve made our public statement.

To us, our reputation as trustworthy deliverers of high quality games and products is imperative to not only our business model, but our integrity and morality as people. We wish to be as transparent as we can as a way of restoring the trust that we have been forced to break due to the actions of our American contractor.
